Terms and Conditions Agreement for Swim Lessons
Please read the following terms and conditions carefully before enrolling in swim lessons with True Potential LLC. These terms outline the risks associated with swim lessons, our 24-hour cancellation policy, and other important information that you need to be aware of.
Assumption of Risks:
a. Participation in swim lessons involves inherent risks. These risks include, but are not limited to, the risk of injury, illness, drowning, and accidents that may result from swimming activities. By enrolling in our swim lessons, you acknowledge and assume these risks.
b. It is your responsibility to disclose any pre-existing medical conditions or physical limitations that may affect your ability to participate in swim lessons. We recommend consulting with a healthcare professional before enrolling, especially if you have any concerns about your health or fitness level.
c. You understand and accept that the instructors and staff at True Potential LLC will make reasonable efforts to provide a safe learning environment but cannot guarantee your safety or prevent all accidents or injuries.
Eligibility and Parental Consent:
a. Swim lessons provided by True Potential LLC are open to individuals of all ages, provided they meet the specified requirements for the particular class or program. Participants under the age of 18 require parental consent to enroll.
b. As a parent or legal guardian, by agreeing to these terms and conditions, you provide consent for your child under the age of 18 to participate in swim lessons with True Potential LLC. You acknowledge that you have read, understood, and agreed to these terms and conditions on behalf of your child.
24-Hour Cancellation Policy:
a. If you need to cancel or reschedule a swim lesson, you must provide a minimum of 24 hours' notice. Failure to do so may result in the forfeiture of the lesson, and no refund will be provided.
b. Cancellations made with at least 24 hours' notice will be eligible for rescheduling or a refund, subject to availability and our discretion.
c. In case of unforeseen circumstances such as illness or emergencies, exceptions to the 24-hour cancellation policy may be considered. Please contact True Potential LLC as soon as possible in such situations.
Fees and Payments:
a. All fees for swim lessons provided by True Potential LLC are clearly stated and must be paid in full prior to the commencement of the lessons unless otherwise agreed upon in writing.
b. True Potential LLC accepts payment via Zelle or credit cards. Zelle payments should be sent to truepotentialmc@gmail.com. Credit card payments can be processed through our secure payment gateway.
c. Refunds for canceled lessons will be provided in accordance with our cancellation policy.
Code of Conduct:
a. Participants in swim lessons provided by True Potential LLC are expected to behave in a respectful and responsible manner. Any behavior that jeopardizes the safety or well-being of others will not be tolerated.
b. True Potential LLC reserves the right to refuse service or discontinue lessons for any participant who engages in disruptive, disrespectful, or unsafe conduct, without refund or reimbursement.
Liability and Indemnification:
a. By enrolling in swim lessons provided by True Potential LLC, you agree to release, waive, discharge, and hold harmless the company, its owners, instructors, and staff from any and all claims, demands, damages, losses, or liabilities arising out of or related to your participation in swim lessons, including any injuries or accidents that may occur.
b. You agree to indemnify and defend True Potential LLC, its owners, instructors, and staff against any claims brought by third parties arising from your participation in swim lessons.
c. True Potential LLC and its instructors shall not be held liable for any accidents, injuries, or damages that occur at homes with backyard pools used for swim lessons, including any facilities rented or utilized for swim lessons. The homeowner or facility owner shall assume full responsibility for maintaining a safe environment and complying with all applicable regulations and requirements.
Modification of Terms:
a. True Potential LLC reserves the right to modify, amend, or update these terms and conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website or notifying you by email or other means.
